In April 2001 in Kansas City, Kansas, United States, Marc Sappington went on a murder spree and was subsequently convicted of murdering four acquaintances. He gained notoriety for eating part of the leg of one of his victims, Alton "Fred" Brown. In July 2002, four Ukrainians were arrested in Kyiv for killing and eating a teenage girl. Dengiz, who lived with his parents, arrived at the family house and placed the remaining parts of the body in the refrigerator without saying a word to his parents. On October 8, 2007, Mexican police arrested José Luis Calva Zepeda for murder. Numerous pieces of cooked human flesh were discovered in his house.

This is as moronic as the rest of the allegations. The former president has the legal right to access any and all of the documents created during his presidency, classified or otherwise. Moreover, the second before he left office, by his very actions alone in taking the documents, it can be said that he declassified them. This was discussed at length in 2017 when he handed classified information to the Russian foreign minister. The former president cannot be charged under the Espionage Act of 1917 for this reason and more, including Article II Sec 1 of the Constitution. He is the executive branch, commander in chief, and is not limited by subordinates or agency regulations in the exercise of this power. There is separation of powers as well, meaning Congress cannot diminish a core power of the presidency by statute. And imagine if he could be charged, with endless debates over bureaucratic processes followed or not followed, and the impact that would have on the ability of a president to exercise his executive powers. Among other reasons as well, this is why many of us argue that a sitting president cannot be inducted. Obviously, Trump here is a former president. But that gets back to my point about interpreting a president’s action upon his departure. Now we get to document possession issue. Under the Presidential Records of 1978, there are no penalties or enforcement mechanisms. Clearly, the law was never intended to be used as a criminal statute or prosecutorial tool against a former president. And there’s nothing in the legislative history to support such an effort. A former president is given great latitude in access to documents, classified or otherwise. Even judicial review is very limited, as courts have said in other circumstances. The point is, the second after a president leaves office he’s not subject to criminal charges or penalties if he has documents or other information. The Act anticipates negotiations between a former president and the Archives related to the nature of information, disposition of the information, etc. This is a process. That said, other than the boxes seized by the FBI, obviously millions of pages of records created in the Trump administration are controlled by the Archives. This fact, and the fact that there have been lawyer-to-lawyer negotiations over the remaining boxes, as well as voluntary access to the former president’s home, belies the absurd claim that he “stole” government property or “obstructed” the Archives somehow or had criminal intent, etc. Indeed, the former president was out of office only 12 months when the issue of boxes became known publicly. That’s a very short period of time. Sometimes negotiations go on for years. If there was some sudden urgency in controlling the documents, there were many ways to obtain them without resorting to the criminal process. In fact, it’s shocking that a federal grand jury in DC has been empaneled in the first place, not to mention spies and others at Mar-a-Largo allegedly secretly leaking to the FBI. What’s going on here? Even if it’s believe that documents are being moved or destroyed, the FBI had the power to remove them via a subpoena enforced by a subsequent court order if necessary. If there’s actual evidence something was destroyed, real probable cause, and the government truly believes a crime was committed, then go to a real judge and seek an arrest warrant. But what occurred here was the issuance of a general warrant, in violation of the Fourth Amendment, enabling the government to grab everything in sight for a period of nine hours, and even search the former First Lady’s clothes closet. That’s why, at least in part, this indicates the use of a pretext to search for information related to other matters, like Jan. 6. It’s no accident that the same US attorney overseeing the Archives investigation is overseeing the Jan. 6 investigation. Also, why was a matter of such constitutional consequence heard by a master, not an Art. III federal judge? A master is not confirmed by the Senate. And if there was some kind of urgency, AG Garland was slow to authorize the seeking of a search warrant. And once secured, the warrant wasn’t executed for three days. Again, this is why there’s speculation about the government’s actual intentions. As I hope you can see, this entire event is appalling. Especially when you consider further that Hillary Clinton and James Comey, neither of whom were president with the attendant protections, were never subjected to a search warrant, given every deference, and never indicted.

Something Upon Which Americans Can Agree: The FBI and the IRS Suck. Tax collectors and federal cops have always been rotten to the core. Reason Magazine J.D. TUCCILLE 8.15.2022 7:00 AM There's no doubt that both the FBI and IRS are having a tough moment with the public. Perceptions that the national police agency is at war with half of the population have eroded its standing, while Biden administration plans to super-size the tax-collection agency further sour public perceptions of that never-popular arm of government. It might all be very depressing if you work in the public sector, or you could say that Americans are finally gaining a more realistic assessment of deeply flawed federal enforcers. Over the past week, headlines have featured massive increases in funding for the IRS and a job ad seeking tax collectors "willing to use deadly force" as well as a high-profile raid by the FBI on the Mar-a-Lago home of former President Donald Trump unprecedented in the country's history. If any publicity is good publicity, this should have been a shining moment for government arm-twisters. But both agencies are viewed with suspicion by much of the public and suffer continuously sliding approval ratings. Tax collectors are unpopular under the best of circumstances given that they function as licensed muggers in the service of a governing apparatus deeply resented by many of the people from whom they extract funds. In 2015, Bloomberg reported that "IRS workers are miserable and overwhelmed." The article noted that Americans are sour on the revenue service and that even agents' families and friends view what they do with horror. The service's standing has been further worsened by revelations that its agents are political players. "The IRS has long been disliked, but its employees aren't used to being vilified, " Bloomberg's Devin Leonard and Richard Rubin added. "In May 2013 the agency disclosed that it had given extra scrutiny to Tea Party groups that were seeking nonprofit status. To Democrats, the decision to group together Tea Party applications and other politically oriented groups was merely a misguided attempt to find a consistent rule after years of muddled policy. … To Republicans, the IRS's hard look at Tea Party groups proved the service has a political bias." This is the government agency Americans see getting handed an additional $80 billion even as it advertises for hires eager to "carry a firearm" and "willing to use deadly force." That doesn't go down well with everybody. Historically, the FBI enjoyed greater public trust than the IRS, though it really deserved nothing of the sort. In recent years, though, its reputation has taken a beating. "Internal and external reports have found lapses throughout the agency, and longtime observers, looking past the partisan haze, see a troubling picture: something really is wrong at the FBI, " Time's Eric Lichtblau reported in 2018. "The FBI's crisis of credibility appears to have seeped into the jury room. The number of convictions in FBI-led investigations has declined in each of the last five years." In addition to leaks, mismanagement, and internal chaos, the bureau has been plagued by charges of politicization. Led by then-President Trump, Republicans saw a biased agency that favored their political opponents. That impression is fueled by continuing allegations of favoritism from current and former FBI agents compiled by GOP lawmakers, making it relatively easy for Trump to convince supporters that the raid on his home was politically motivated. Unsurprisingly, public support for both the IRS and FBI have taken a hit. While it's difficult to separate disappearing faith in those two agencies from erosion in the government's overall standing, Gallup found approval of both the FBI and the IRS plunging by 13 points from 2019 to 2021. Like almost everything else these days, there's a partisan cast to those numbers. In this polarized environment, while Americans are divided about the FBI's search of Mar-a-Lago, 76.5 percent of Republicans see "Trump's political enemies" behind the search, according to the Trafalgar Group, while 70.5 percent of Democrats attribute the raid to "the impartial justice system." The recent empowerment of the IRS breeds more nonpartisan reaction, with 42 percent of Democrats and 48 percent of Republicans fearing increased audits, according to Politico/Morning Consult. While much of the public may believe empty assurances that tax collectors' efforts will be directed at the wealthy, a substantial number disagree, possibly because of recent reports that low-income wage earners are targeted much more often than those with more money. IRS efforts "resulted in these low-income wage earners with less than $25, 000 in total gross receipts being audited at a rate five times higher than for everyone else, " Syracuse University's Transactional Records Access Clearinghouse noted in March of this year. You have to place a lot of faith in assurances from widely distrusted federal employees to think tax collectors will stop going after people who have limited resources with which to defend themselves. While the headlines about the FBI and IRS are eye-grabbing, the related erosion in support is long overdue. Both government agencies have histories of abusive, corrupt, and high-handed conduct. They also have track records of political weaponization—not against one party alone, but on behalf of whoever is in power against critics and opponents. "The FBI … has placed more emphasis on domestic dissent than on organized crime and, according to some, let its efforts against foreign spies suffer because of the amount of time spent checking up on American protest groups, " the Senate's Church Committee complained in 1976. "Two years after cases of gross misconduct by senior Internal Revenue Service officials began surfacing, a House committee has determined that the problems are widespread and probably include at least 50 to 60 'serious' examples of abuse of office, " The Chicago Tribune reported in 1990. "Since the advent of the federal income tax about a century ago, several presidents—or their zealous underlings—have directed the IRS to use its formidable police powers to harass or punish enemies, political rivals, and administration critics, " The Christian Science Monitor observed in 2013. "Nearly every examiner in an elite FBI forensic unit gave flawed testimony in almost all trials in which they offered evidence against criminal defendants over more than a two-decade period before 2000, " The Washington Post reported in 2015. That's an impressively awful record for two agencies that are finally losing substantial public support. The IRS and the FBI aren't bad because they're under the control of the wrong political party, they're bad because they've always been rotten to the core. At a moment of national revelation about the flaws of tax collectors and federal cops, Americans need to realize that we're all at risk.

Corruption FBI Director Calls Legit Criticism Of Corrupt FBI ‘Violence, ’ But We Weren’t Born Yesterday By: Margot Cleveland August 12, 2022 Why is Christopher Wray more concerned about criticism than Americans’ complete distrust of his corrupt agency? FBI Director Christopher Wray’s Thursday statement represents a disgraceful attempt to silence critics by conflating condemnation of the bureau’s conduct with violence and threats against law enforcement. This outrageous tactic will not work, and that Wray resorted to it confirms he no longer deserves to be FBI director. “Unfounded attacks on the integrity of the FBI erode respect for the rule of law and are a grave disservice to the men and women who sacrifice so much to protect others, ” Wray began his short, four-sentence statement, before immediately pivoting to the truism that “violence and threats against law enforcement, including the FBI, are dangerous and should be deeply concerning to all Americans.” By calling criticism “attacks” and then immediately warning the country of the danger “violence and threats” against the FBI pose, Wray deceitfully framed legitimate speech as violence or, at a minimum, the threat of violence. The object of this framing is obvious: to silence Americans who have finally found their voice following the FBI’s raid of Trump’s private residence at Mar-a-Lago. In a country founded on first freedoms — foremost of which is free speech — Wray’s statement proves shocking. But worse still is the reality that the FBI already identifies patriotic and historic speech and symbols as suspect of violent extremism, such as when groups profess, “Don’t Tread On Me” on an emblem of the Gadsden flag or challenge with the Gonzales flag, “Come and Take It.” While Wray’s effort to equate speech and violence proves the most offensive part of his Thursday statement and one that merits universal condemnation, the director’s attempt to sweep away the legitimate criticism of the bureau as “unfounded” deserves derision as well. There is nothing “unfounded” in the condemnation of the FBI for its handling of the Crossfire Hurricane investigation, and it is because of that widespread misconduct that Americans doubt the legitimacy of the FBI’s decision to search the former president’s home. Crossfire Hurricane revealed that agents at the highest levels in the bureau held an anti-Trump political bias. The inspector general’s report established that the FBI submitted four FISA applications replete with lies and material omissions, allowing agents to obtain a court order to surveil Carter Page in violation of Page’s constitutional rights. And Americans discovered the FISA court served as no real check on the FBI’s abuse. The country also learned that the FBI used a backdoor conduit in Bruce Ohr to continue to accept “intel” from Christopher Steele after terminating him as a “confidential human source.” The Mueller report revealed that for all the talk about investigating Russian interference in the election, the FBI ignored the obvious question of whether Steele had been fed Russian disinformation to meddle in our affairs. And the trial of Michael Sussmann revealed how nonchalant the FBI was about being misled. There is nothing “unfounded” about any of these criticisms, and it is precisely because of their legitimacy — and that they all flowed from a “get-Trump” mentality — that the country now condemns the FBI’s raid on Trump’s home. Further, even if this time the FBI (and its sources) didn’t lie and the court didn’t rubber stamp the search warrant, the raid still deserves condemnation because of the obvious double-standard. The FBI never raided Hillary Clinton’s home during the FBI’s investigation of the former secretary of state for mishandling classified documents. Consequently, Clinton had time for her minions to wipe her homebrew server with BleachBit, making it impossible for the FBI to recover some emails. The FBI also didn’t raid Clinton’s houses to search for the 13 mobile devices it believed she might have used to email her staff. The DOJ instead asked Clinton’s lawyers to provide the Blackberries and other devices to agents. Clinton’s attorneys later told the FBI “they were unable to locate any of these devices.” The double standard appears also to apply to Hunter Biden, unless the FBI somehow succeeded in quietly searching his residences without anyone’s notice. But even that would contrast with how agents treated Roger Stone, when the media amazingly knew to be handy during the pre-dawn raid and search of the Trump ally’s home. And these are but a few of the many examples of disparate treatment based on political affiliation. Nor is criticism of the FBI’s broader handling of the Hunter Biden case “unfounded, ” as multiple whistleblowers recently made clear when they told Sen. Chuck Grassley, R-Iowa, that FBI headquarters buried verified or verifiable evidence implicating the son of the now-president. That those whistleblowers only came forward with these details in the last two months, even though the alleged misconduct dates to 2020, raises other well-founded reasons to “attack” the bureau. If “every day see the men and women of the FBI doing their jobs professionally and with rigor, objectivity, and a fierce commitment to our mission of protecting the American people and upholding the Constitution, ” as he claims, then why did these whistleblowers only now come forward? Were they not as rigorous and committed as Wray thought? Or were they too afraid of what would happen to them and their careers if they blew the whistle, suggesting they aren’t quite as “fierce” as Wray assumed? Or maybe there’s a more widespread lack of commitment to the Constitution? Wray should ponder these questions and also ask himself why he seems more offended at the public’s criticism than he is at the agents and leaders who caused the country to consider the FBI the bad guys. And with yesterday’s outrageous attempt to spin Americans’ criticism as calls to violence, Wray should be given lots of free time on which to reflect.
