FBI, R.I.P.? The agency has become dangerous to Americans and an existential threat to their democracy and rule of law. By Victor Davis Hanson August 10, 2022 The FBI is dissolving before our eyes into a rogue security service akin to those in Eastern Europe during the Cold War. Take the FBI’s deliberately asymmetrical application of the law. This week the bureau surprise-raided the home of former President Donald Trump—an historical first. A massive phalanx of FBI agents swooped into the Trump residence while he was not home, to confiscate his personal property, safe, and records. All of this was over an archival dispute of presidential papers common to many former presidents. Agents swarmed the entire house, including the wardrobe closet of the former first lady. Note we are less than 90 days out from a midterm election, and this was not just a raid, but a political act. The Democratic Party is anticipated to suffer historical losses. Donald Trump was on the verge of announcing his 2024 presidential candidacy. In many polls, he remains the Republican front-runner for the nomination—and well ahead of incumbent Joe Biden in a putative 2024 rematch. In 2016 then FBI Director James Comey announced that candidate Hillary Clinton was guilty of destroying subpoenaed emails—a likely felony pertaining to her tenure as secretary of state. Yet he all but pledged that she would not be prosecuted given her status as a presidential candidate. As far as targeting presidential candidates, Donald Trump was impeached in 2020 ostensibly for delaying military aid to Ukraine by asking Ukrainian officials to investigate more fully the clearly corrupt Biden family—given Joe Biden at the time was a likely possible presidential opponent in 2020. The FBI has devolved into a personal retrieval service for the incorrigible Biden family. It suppressed, for political purposes, information surrounding Hunter Biden’s missing laptop on the eve of the 2020 election. Previously, the FBI never pursued Hunter’s fraudulently registered firearm, his mysterious foreign income, his felonious crack cocaine use, or his regular employment of foreign prostitutes. Yet in a pre-dawn raid just before the 2020 election, the FBI targeted the home of journalist James O’Keefe on grounds someone had passed to him the lost and lurid diary of Ashley Biden, Biden’s wayward daughter. At various times, in Stasi-style the FBI has publicly shackled Trump economic advisor Peter Navarro, swarmed the office of Trump’s legal counsel Rudy Giuliani, and sent a SWAT team to surround the house of Trump ally Roger Stone. Meanwhile, terrorists and cartels walk with impunity across an open border. FBI Director Christopher Wray last week cut short his evasive testimony before Congress. He claimed he had to leave for a critical appointment—only to use his FBI Gulfstream luxury jet to fly to his favorite vacation spot in the Adirondacks. Wray took over from disgraced interim FBI Director Andrew McCabe. The latter admitted lying repeatedly to federal investigators and signed off on a fraudulent FBI FISA application. He faced zero legal consequences. McCabe, remember, was also the point man in the softball Hillary Clinton email investigation—while his wife was a political candidate and recipient of thousands of dollars from a political action committee with close ties to the Clinton family. McCabe took over from disgraced FBI Director James Comey. On 245 occasions, Comey claimed under oath before the House Intelligence Committee that he had no memory or knowledge of key questions concerning his tenure. With impunity, he leaked confidential FBI memos to the media. Comey took over from Director Robert Mueller. Implausibly, Mueller swore under oath that he had no knowledge, either of the Steele dossier or of Fusion GPS, the firm that commissioned Christopher Steele to compile the dossier. But those were the very twin catalysts that had prompted his entire special investigation into the Russian collusion hoax. FBI legal counsel Kevin Clinesmith was convicted of a felony for altering an FBI warrant request to spy on an innocent Carter Page. The FBI, by Comey’s own public boasts, bragged how it caught National Security Advisor designate General Michael Flynn in its Crossfire Hurricane Russian collusion hoax. As special counsel, Mueller then fired two of his top investigators—Lisa Page and Peter Strzok—for improper personal and professional behavior. He then staggered their releases to mask their collaborative wrongdoing. Mueller’s team deleted critical cell phone evidence under subpoena that might well have revealed systemic FBI-related bias. The FBI interferes with and warps national elections. It hires complete frauds as informants who are far worse than its targets. It humiliates or exempts government and elected officials based on their politics. It violates the civil liberties of individual American citizens. The FBI’s highest officials now routinely mislead Congress. They have erased or altered court and subpoenaed evidence. They illegally leak confidential material to the media. And they have lied under oath to federal investigators. The agency has become dangerous to Americans and an existential threat to their democracy and rule of law. The FBI should be dispersing its investigatory responsibilities to other government investigative agencies that have not yet lost the public trust.

President Barack Obama nominated Merrick Garland for the United States Supreme Court in 2016. With the presidential election looming that coming November, Majority Leader Mitch McConnell halted the nomination and refused to allow it to even go to the Judiciary Committee, let alone to the floor of the Senate for a confirmation vote. This immediately made Garland a major issue in the 2016 presidential campaign. Donald Trump vowed to personally remove his name as a nominee for the high court should he win the election, and that became part of the reason for his historic and unlikely victory. Trump won. Garland's name was withdrawn, and his hopes of landing the lifetime appointment to the Supreme Court and a place in American history were dashed forever. Fast-forward to last year when Joe Biden became the accidental place-holder president for the Establishment and the Deep State. He made Garland Attorney General partially as a consolation prize and partially as a symbolic message to Trump and Republicans. In the intervening months since taking his position, he's dutifully done the bidding of the Biden White House, including the outrageous decision to set up a special FBI task force to investigate parents who protest at school board meetings as domestic terrorists. Whatever Biden, the Democrats, and their special interest overlords demanded, he was quick to comply. You want parents investigated? You got it! You want extra investigations into new voting laws in Republican states? We'll double our investigative staff! You want hundreds of Trump supporters arrested for "illegal parading" on January 6th to languish in jail for over a year before they get a court date? Done! You want midnight raids on advisors to the president to intimidate them into testifying to the January 6th kangaroo committee? You don't even need to ask! You want Bannon arrested and convicted? No problem! Any chance this petty, little, vindictive man had to use his department as a political tool to punish the enemies of the American left, he took it. And it all led to yesterday's Banana Republic cosplay in West Palm Beach, Florida. Under the guise of the Presidential Records Act (seriously? ), 30 FBI agents stormed into the home of the former president and conducted an authoritarian fishing expedition seizing whatever documents they wanted without even perusing them to see if they matched the criteria of their sham search warrant, broadcasting their third-world larping around the planet to send the message that the FBI was treating Donald Trump like a mafia boss and common criminal. And Merrick Garland oversaw the entire pathetic scene. This angry, bitter Napoleon should never have had anything to do with the chain of command regarding any issue pertaining to Donald Trump. As detailed above, he has a very personal reason to despise the former president. Trump single-handedly kept Garland off the Supreme Court. And now, he's in the position as chief law enforcement officer in America to release the full weight and power of the FBI on the man who thwarted his career and ambition. That's not just a conflict of interest, that's a murder plot in a John Grisham thriller. In fact, it goes well beyond the obvious conflict of interest stemming from the "Revenge factor" over the events of 2016. Garland has a vested interest in stopping Donald Trump so as to advance his future political and financial fortunes. You see, Donald Trump is not just a former president, he is also a future presidential candidate. He will likely run against Garland's current boss. If Trump wins, he would once again end Garland's current run as attorney general, and he would, once again, end any future prospects of Garland getting another Supreme Court nomination. If Trump wins the next election, Garland's career is pretty much over. So Garland uses his power to help make sure that doesn't happen. This is what the professionals who care about these things refer to as the appearance of impropriety and a direct conflict of interest. Jeff Sessions recused himself as attorney general for anything pertaining to the Russian Collusion hoax because he had a bowl of borscht at a Trump Tower restaurant or something stupid like that. And Garland doesn't feel any pressure to recuse over his obvious, direct, past, present, and future conflict with Donald Trump? You make sense of it... I've lost the energy to even try.

The 20 Republican Senators Who Voted To Confirm Merrick Garland Owe America An Apology By: Elle Reynolds August 09, 2022 Republicans who aren’t actively opposing Garland’s political weaponization of federal law enforcement are part of the problem. After Merrick Garland’s Department of Justice oversaw an FBI raid on the private home of former President Donald Trump, the 20 Republicans who joined Democrats to confirm Garland’s nomination as attorney general must emphatically condemn the nominee they once supported or voters should replace them in their primaries. When Garland was confirmed in March 2021, only 30 of 50 Republican senators voted against it. The other 20 — Senators Blunt, Burr, Capito, Cassidy, Collins, Cornyn, Ernst, Graham, Grassley, Inhofe, Johnson, Lankford, McConnell, Moran, Murkowski, Portman, Romney, Rounds, Thune, and Tillis — all joined Democrats to approve Garland’s nomination. Some of those 30, like Grassley and Johnson, have since strongly criticized Garland’s tenure as attorney general and had already condemned the raid by Tuesday morning, to their credit. But others have been conspicuously silent, including Senate Minority Leader Mitch McConnell, who praised Garland’s “long reputation as a straight-shooter and legal expert” at the time of his confirmation. Sen. Lindsey Graham of South Carolina said Garland “would be a sound choice to be the next Attorney General. He is a man of great character, integrity, and tremendous competency in the law.” Although some tried to portray Garland as a “moderate, ” he had already shown by the end of his confirmation hearings that he was far from it. In accepting Biden’s nomination, Reuters reported, “Garland said he believes the department’s top priorities will be ‘ensuring racial equity’ and ‘meeting the evolving threat of violent extremism.’” That’s easy code for pushing leftist race politics and targeting conservatives whom Garland views as a political threat. In his hearing, Garland refused to answer “whether illegally entering the country should remain a crime.” He also refused to say whether he would protect female athletes from having their privacy and victories interrupted by men, and refused to commit to releasing special counsel John Durham’s report probing the Russia collusion hoax against Donald Trump. Those red flags and others contributed to opposition from senators like Tom Cotton, Ted Cruz, Rick Scott, Josh Hawley, Marsha Blackburn, Rand Paul, Marco Rubio, and others. Cruz explained his “no” vote on Garland’s confirmation because Garland had “refused to make clear that he would stand against the politicization of the department, which we saw during the Obama-Biden years.” Scott called Garland a “radical” who might “politicize” the Department of Justice. In a scathing takedown of Garland’s positions, Cotton said that “when he did answer questions, he sounded more like a liberal ideologue who would embrace the radical agenda of the Democratic party’s far left base.” “If confirmed, ” Cotton added, “I’m afraid that he’ll enable extremists in the Justice Department to undermine our police, our Constitution, and our rule of law.” Since his appointment, Garland has continued showing himself to be nothing but a partisan hack. One of his most stunning acts of corruption was the reliance on a letter from the National School Boards Association — since revealed to have been planted by the Biden Education Department — to sic the FBI on concerned parents showing up to school board meetings. After the Supreme Court’s leaked Dobbs decision saw radical abortion activists firebombing and vandalizing pregnancy support clinics around the country, Garland put more public effort into opposing the decision than opposing the violence. He refused to enforce the law when demonstrators waged a pressure and intimidation campaign at justices’ private homes, culminating in an assassination attempt on Justice Brett Kavanaugh’s life. In other Supreme Court decisions too, the Garland DOJ has shown its politicization by “respectfully disagreeing” with outcomes it has no legitimate reason to comment on. It has raided other Republicans’ homes in an obvious lead-up to its Mar-a-Lago raid. And Garland has ignored whistleblower reports that the FBI covered up evidence against Hunter Biden in the lead-up to the 2020 presidential election involving his father. Under Garland, the DOJ refused to investigate the deaths of thousands of elderly nursing home residents at the hands of incompetent blue state leaders who forced Covid patients into their facilities. Garland personally announced the DOJ’s lawsuit against Texas for its law protecting the lives of babies in utero after a heartbeat is detectable. It’s obvious Merrick Garland is no “straight shooter, ” and Republicans who aren’t actively opposing the political weaponization of his federal law enforcement agency are part of the problem. Voters should be watching how their elected representatives respond — or don’t — to his most recent and most outrageous abuse of power.

Justice Department should have subpoenaed documents, not raided Trump’s home The Hill 8-9-22 ALAN M. DERSHOWITZ The decision by the Justice Department to conduct a full-scale morning raid on Donald Trump’s Mar-a-Largo home does not seem justified, based on what we know as of now. If it is true that the basis of the raid was the former president’s alleged removal of classified material from the White House, that would constitute a double standard of justice. There were no raids, for example, on the homes of Hillary Clinton or former Clinton administration national security adviser Sandy Berger for comparable allegations of mishandling official records in the recent past. Previous violations of the Presidential Records Act typically have been punished by administrative fines, not criminal prosecution. Perhaps there are legitimate reasons for applying a different standard to Trump’s conduct, but those are not readily obvious at this stage. The more appropriate action would have been for a grand jury to issue a subpoena for any boxes of material that were seized and for Trump’s private safe that was opened. That would have given Trump’s lawyers the opportunity to challenge the subpoena on various grounds — that some of the material was not classified; that previous classified material was declassified by Trump; that other documents may be covered by various privileges, such as executive or lawyer-client. Instead, the FBI apparently seized everything in view and will sort the documents and other material without a court’s deciding which ones are appropriately subject to Justice Department seizure. Searches and seizures should only be used when subpoenas are inappropriate because of the risk of evidence destruction. It is important to note that Trump himself was 1, 000 miles away when the FBI’s search and seizure occurred. It would have been impossible, therefore, for him to destroy subpoenaed evidence, especially if the subpoena demanded immediate production. If he or anyone else destroyed evidence that was subject to a subpoena, that would be a far more serious crime than what the search warrant seems to have alleged. It is unlikely that there is a basis for believing that the search warrant was sought because of a legitimate fear that subpoenaed evidence would be destroyed. Defenders of the raid argue that the search warrant was issued by a judge. Yet every criminal defense lawyer knows that search warrants are issued routinely and less critically than candy is distributed on Halloween; judges rarely exercise real discretion or real supervision. It may be different when a president’s home is the object of the search, but only time will tell whether that was the case here. Neutral, objective justice must not only be done: it must be seen to be done. For zealous Trump haters, anything done to Trump is justified. For zealous Trump lovers, nothing done to him is ever justified. For the majority of moderate, thoughtful Americans, however, the Justice Department’s raid likely seems — at least at this point in time — to be unjust or needlessly confrontational. Thus, it is now up to the Justice Department and the FBI to justify their actions to the American public. They must explain why a different standard appears to have been applied to Democrats such as Clinton and Berger than to Republicans such as Trump and many of his associates. Critics of this demand for a single standard of justice insultingly call it “whataboutism.” A more appropriate term would be “the shoe on the other foot test.” No government act should ever be accepted unless it would be equally applied if the shoe were on the other foot — in other words, if it were applied equally to political friends and foes. This is the essence of our constitutional requirement of the equal protection of the law. For now, let’s not rush to judgment. Let’s give the attorney general, Merrick Garland, and the director of the FBI, Christopher Wray, the opportunity to explain their actions. If they decline to do so, on the basis of confidentiality, a special master should be appointed by the relevant court to assess the evidence seized from Trump’s home on a confidential basis. In the alternative, a true congressional committee comprised of both Democrats and Republicans should be appointed to investigate this raid.

Origins & Leadership The AP and PolitiFact correctly state that the Klan was started by a group of Confederate veterans in Pulaski, Tennessee as a non-violent, grassroots social club without political motivations. What the AP and PolitiFact fail to acknowledge is that the Klan’s 1865–66 founding as a social club does not mark the beginning of the Klan as it is known today. Per the 1971 academic book White Terror: The Ku Klux Klan Conspiracy and Southern Reconstruction, the “real beginning” of the “Ku Klux conspiracy” occurred at an 1867 meeting in Nashville that consolidated the Klan. As explained by an 1884 book written by a founding member of the Klan, this meeting bound the “isolated dens together” with “unity of purpose and concert of action” to supposedly reign in rogue Klansmen that had turned violent toward black people just a year after the group’s founding. However, White Terror points out that if Klan leaders really wanted to eliminate violence, they would have disbanded altogether. Instead, they sought “tighter organization” and recruited leaders “of far greater prestige and authority whose influence extended throughout the state”—primarily ex-Confederate generals and Democratic politicians. An investigation published by the Illinois General Assembly in 1976 explains that after the Klan “transformed into a political organization, ” violence became more widespread under Democrat leadership. The men that guided the Klan’s reorganization and subsequent growth included: Nathan Bedford Forrest—first Grand Wizard of the Klan and a Democratic Memphis alderman. John W. Brown—“probable leader” of the Klan and a Democratic governor of Tennessee. Edmund Pettus—Grand Dragon of the Alabama Klan and a Democratic senator from Alabama. However, the Illinois investigation also found that “central control over the actions of the various local Klan groups did not really exist, ” and some of the figureheads above began “dropping out” to distance themselves from local terrorism. For example, Nathan Bedford Forest ordered the Klan disbanded in 1869 because he claimed a “few disobedient and bad men” had infiltrated the Klan, disgracing its “good name and honorable reputation.” On the other hand, some prominent Democrats remained loyal to the Klan’s violent activities. For example, Fredrick Strudwick led a Klan attempt to assassinate a Republican state senator and was later elected as a Democrat to the North Carolina state legislature. Likewise, the Red Shirts—a “paramilitary extension” of the Democratic Party and essentially the “Klan in a different uniform”—attacked a black militia in 1867 for refusing to surrender their guns to the leader of another militia that “had no legal right” to the weaponry. One participating Red Shirt leader named “Pitchfork” Ben Tillman became the Democratic Governor of South Carolina and a U.S. Senator. He recalled what became known as the Hamburg Massacre (in Edgefield county) with pride: White men in Edgefield planned “to seize upon the first opportunity” to “provoke a riot and teach the Negroes a lesson” because they believed that “nothing but bloodshed and a good deal of it” could succeed in “redeeming the state from negro and carpet bag rule.” The goal “of our visit to Hamburg was to strike terror, ” and “seven dead negros lying stark and stiff, certainly had its effect.” The massacred black people were “offered up as a sacrifice to the fanatical teachings and fiendish hate of those who sought to substitute the rule of the African for that of the Caucasian in South Carolina.” The AP reports that “many” Democrats joined the Klan, and PolitiFact reports “some” did and that Nathan Forest spoke at a Democratic National Convention, but this is the extent of their admissions of Democrats’ membership in the Klan. Media Whitewashing Even though some individual Democrats denounced the violence of the Klan, Democratic politicians and their media allies consistently covered up for it. A 2011 paper in The Journal of Southern History explains that Democratic newspapers published “blanket denials” of the Klan’s existence “during and after its most active period of violence.” This is exemplified by the New York Tribune’s criticism of Democratic papers in 1868 for dismissing the Klan as a “mythical maggot of distempered Republican brains.” Democratic politicians followed suit, including: Democratic Governor Robert Lindsay, who testified before Congress in 1871 that “reported outrages by Ku-Klux or disguised persons had ceased for the last two years” in Alabama. former Democratic Governor John Stevenson who claimed in 1871 that there was “no evidence” of “any secret political organization” in Kentucky. Such denials were pervasive throughout the Democratic Party and media. As documented by White Terror: “Most Democrats asserted that no regular or continuing Ku Klux organization existed in their counties, or in the state, ” and they “denied even more vehemently that the disguised bands were politically motivated.” “Few Democrats were willing to admit the Klan’s political character and purpose.” “The Democratic press in Louisiana played its familiar role as Klan apologist.” “Democratic newspapers continued to ignore violence more than they condemned it.” The “only native whites who stood out in significant numbers against the Klan” were Republicans. In 1871, a Congressional committee exposed the Klan’s mass terror and called for federal intervention in the South. Congressional Democrats pushed back, issuing their own report which stated that: it is “folly and madness” to claim that “any country can prosper where the Anglo-Saxon is made politically subordinate to the African.” government cannot “long exist ‘half black and half white.’ ” the disguised men perpetrating violence in the South do not “have any general organization, or any political significance” and their conduct is not “indorsed by any respectable number” of white people. “Terrorist Arm of the Democratic Party” In direct contrast to the claims of Democratic politicians and the media that the Klan had no “political significance, ” Klansmen used violence and intimidation to serve the interests of the Democratic party.
